Paying Support For a Child That Isn’t Yours in California?

If you are paying support for a child that is not yours, you have one more chance to correct this wrong. California has become the eleventh state in the country to enact legislation for men who have wrongly been pegged as the father of a child and ordered to pay support for that child.

If you have an order to pay child support that was entered by default, not allowing you to obtain genetic testing, the court will allow your order to be set aside to determine if you are the biological father of the child. If the testing determines that you are not the biological father, you will no longer be required to pay child support.

If this issue applies to you, do not delay. This law is only effective until October 2006.

Recent studies suggest that 40% of women withhold children from their father during a divorce. If this situation occurs, it is important that you confront it immediately. If you do not document the problem, your wife will argue that you did not want or attempt to visit with your kids.

If you do not have a custody order, obtain a temporary order immedatiely. Once you have a custody order, you must enforce it. Enforcement may require police enforcement for pick up of your children, reporting violations of court orders to law enforcement, and contempt actions.

It is important to document all communication with your wife. If your wife is bad mouthing you to the children and they are telling you things that their mother has said, it is imperative to take them to a counselor to allow them to deal with the conflict and allow their voices are documented.

Consult with an attorney regarding your matter. It may be possible to obtain full custody if you can show that your wife continually withholds the children from you and that you would be the parent better able to share the children.

The 1987 Shere Hite’s survey of women found that 70% of women married five years or more had had an extramarital affair.

The 1980 Hite Report on Male Sexuality found that 72% of men married two years or more had had an extramarital affair.

Approximately 15% of women and 25% of men have more than four affairs during their married lives.

Fewer than 10% of people having affairs divorce their spouse and marry their lover (of which 75% of these marriages end in divorce).

Affairs, infidelity, cheating, being unfaithful, no matter what you call it, nobody wants to be on the ignorant end. Affairs are not the top reason for divorce but they are the worst reason. This is compounded by the fact that not only do you have to come to terms with the fact that your wife was cheating, you will probably now have to keep her in the lifestyle to which she has become accustomed.

In short, the answer is yes.  Children can thrive after divorce. To help your children cope with divorce, fathers should continue to maintain significant contact with their children.  On days when a parent does not see a child, there should be telephonic contact at a certain time each day such as after school, after dinner, or before bed.  Fathers should live within close proximity of Mom’s house and the children’s school.  Fathers should attend school activities and request that all school information be forwarded to their address as well as Moms.  Children thrive when parents set aside their differences to work together to co-parent.  Consider having joint birthday parties, consulting on Christmas gifts, and laying down the law together.  If you and your spouse have trouble co-parenting, seek counseling.  It is an excellent idea to have a counselor that you can see from time to time as issues arise.
